1. Services

NBTX Guide provides a New Braunfels local business directory, business profiles, editorial and informational pages, account tools, business submissions, ownership claims, correction requests, and paid listing plans. Specific listing features and pricing are described on the Site, at checkout, or in a written offer.

By creating an account, submitting information, claiming a business, purchasing a listing plan, or using the Site, you agree to these Terms. If you do not agree, do not use the Site or Services.

SMS Messaging Program

NBTX Guide and WhiteBoston may send marketing text messages about local business opportunities, updates, and promotional offers only when you select marketing SMS consent. Account, claim, submission, billing, security, or other transactional notices are separate from marketing consent.

You can cancel marketing SMS messages at any time by replying “STOP” to the number that sent the message. Reply “HELP” or contact info@nbtxguide.com for help. Message frequency varies. Message and data rates may apply. Consent is not a condition of using the Site, submitting a business, claiming a listing, or purchasing a plan. Carriers are not liable for delayed or undelivered messages.

2. Account, Listings, and Communications

Account setup: You must provide accurate and current information when creating an account or using the Site. Keep your login credentials secure and notify us if you believe your account has been used without authorization.

Business submissions and claims: You may submit or claim a business only if you have the authority to provide the information and make the request. You must not submit passwords, payment details, government identification numbers, or other sensitive information in a claim or listing request.

Communications: We may send transactional emails about account verification, password resets, claims, business submissions, listing status, payments, and security. Marketing emails and SMS messages require separate opt-in consent. You may withdraw marketing consent at any time.

Review and publication: We may verify, edit, approve, reject, unpublish, or remove a submission or listing. A submission, claim, or paid plan does not guarantee publication, approval, a particular placement, search ranking, traffic, leads, or business results.

3. Directory Content and Limitations

Business information, hours, prices, services, events, availability, links, and other details can change. NBTX Guide may receive information from businesses, public sources, users, and service providers. We do not guarantee that directory information is current, complete, accurate, or suitable for a particular purpose.

Paid, enhanced, featured, or promotional placement is advertising or business promotion. It is separate from NBTX Guide’s editorial recommendations. Paid placement does not mean that NBTX Guide endorses, certifies, licenses, insures, or guarantees a business or its services.

4. Listing Plans and Founding Rate

The Free plan provides the business basics described on the pricing page. Paid plans add the profile features shown at checkout and on the pricing page.

The current Founding Rate is:

• Enhanced: $149.50 for the first year, then $299 per year
• Growth: $299.50 for the first year, then $599 per year

The discounted Founding Rate applies to the first paid year only. Unless canceled before renewal, the subscription renews at the standard annual price shown above. The checkout page controls the final amount, renewal terms, and any applicable taxes or charges.

Included Services

Plan features labeled with a dollar value are included services, not cash, account credit, or a guaranteed financial benefit. The listed value reflects the price NBTX Guide assigns to that service when offered separately.

• Online visibility report: A review of available public information about the business’s website, directory presence, and search visibility, with observations or recommended next steps. The report does not guarantee rankings, traffic, leads, or corrections by third-party platforms.
• Custom AI chatbot: A business-profile chatbot configured with approved listing information and other content the business provides. Automated responses may be incomplete or inaccurate. The business remains responsible for reviewing its information and must not use the chatbot for emergency, medical, legal, financial, or other high-risk advice.
• Google Business Profile optimization: A review of the business’s Google Business Profile with recommendations or agreed updates using access authorized by the business. NBTX Guide does not guarantee Google approval, placement, rankings, traffic, or leads. Business owners must use Google’s authorized access tools and must not provide account passwords.

5. Fees, Payment, Cancellations, and Refunds

Payment processing: Paid plans are processed through Stripe. Stripe may store payment details for recurring billing. NBTX Guide does not store full payment card numbers.

Subscriptions: Paid listing plans are annual subscriptions unless the checkout page or written offer says otherwise. A subscription may renew automatically at the standard annual price. You may request cancellation by contacting info@nbtxguide.com or using an available billing control. Cancellations generally keep paid features active through the end of the paid term and do not automatically create a prorated refund.

Claim review: When a paid plan is purchased during a pending ownership claim, paid listing features do not activate until the claim is approved. If the claim is rejected, the listing will not activate and the payment is placed in manual refund review.

Refund requests: Refund requests for an active paid listing are reviewed manually. Unless required by law or agreed to in writing, fees are not automatically refundable after paid listing features have been activated. Contact info@nbtxguide.com with the business name, account email, and payment details needed to identify the transaction. Approved refunds are returned through the original payment method when possible.

We may suspend or limit paid features for failed payments, chargebacks, fraud concerns, policy violations, or inaccurate account information. You remain responsible for amounts owed before suspension or termination.

6. Your Responsibilities

You agree to:

• Provide accurate, current, and lawful information
• Maintain the security of your account credentials
• Use the Site and Services only for lawful purposes
• Submit or claim only businesses for which you have authority to act
• Obtain permission for images, logos, text, links, and other content you provide
• Review a business directly before relying on its services, prices, availability, license, insurance, or representations

7. Intellectual Property

NBTX Guide and WhiteBoston LLC own the Site, its design, code, branding, editorial content, workflows, templates, and proprietary materials, except for content supplied by users, businesses, or third parties. You may not copy, scrape, republish, resell, or create a competing database from Site content without written permission.

You retain ownership of content and business information you provide. You grant NBTX Guide a non-exclusive, worldwide, royalty-free license to host, reproduce, edit for clarity and formatting, publish, distribute, and display that content as needed to operate and promote the directory.

8. Confidentiality

We treat non-public information you provide as confidential and use it to provide the Site and Services, except as described in the Privacy Policy, with your direction, or as required by law. Do not submit confidential information in a public listing or claim field.

9. Data and Privacy

Your personal information, business data, and consent records are governed by our Privacy Policy. We do not sell or rent personal information. We do not sell or share SMS opt-in data or consent status for third-party marketing.

10. Prohibited Uses

You may not use the Site or Services to:

• Violate laws or infringe another person’s rights
• Submit false, misleading, defamatory, or unauthorized business information
• Scrape, harvest, redistribute, resell, or repurpose Site data without permission
• Attempt to reverse engineer, disrupt, overload, or interfere with the Site or its systems
• Misrepresent your relationship with a business or with WhiteBoston LLC
• Share account access or credentials with unauthorized third parties
• Use the Site to send spam, malicious code, or unwanted marketing messages

11. Disclaimer of Warranties and Limitation of Liability

The Site and Services are provided “as is” and “as available.” We do not warrant uninterrupted, secure, error-free, complete, or accurate operation. We do not guarantee search rankings, traffic, leads, sales, approvals, listing placement, business outcomes, or the accuracy of third-party information.

To the maximum extent permitted by law, WhiteBoston LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost revenue, profits, data, or business opportunities. Our total liability for any claim will not exceed the amount you paid to us in the six months before the claim, or $100 if you did not pay anything.

12. Indemnification

You agree to defend, indemnify, and hold harmless WhiteBoston LLC, its affiliates, and employees from claims, damages, losses, liabilities, and expenses arising from your use of the Site or Services, your content, your business submission or claim, your violation of these Terms, or your violation of another person’s rights.

13. Termination

We may suspend or terminate access for violation of these Terms, misuse, fraud, nonpayment, security concerns, or conduct that may harm users or the Site. You may stop using the Site at any time. Termination does not affect outstanding fees, rights that accrued before termination, or provisions that by their nature should continue.

14. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of state and federal courts in Texas.

15. Changes to These Terms

We may revise these Terms periodically. Material changes will be posted with an updated effective date. Your continued use of the Site or Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
